Guatemalan Adoptions: U.S. Immigration Requirements:
In US immigration law, an “orphan” is defined as a child adopted overseas and who has been living with the adopted parents for less than two years. If you child fits into this category, then s/he will need an orphan visa petition and orphan visa in order to be allowed to enter the US.
In most cases, this simply means that the US authorities review your case until they are satisfied that the adoption is legal and your child fits the “orphan” category. The child’s petition and visa application are then considered and a final decision reached.
